Per the settlement, Garden of Life will be making substantial adjustments to its newest offering, including (but not limited to) changing the product line name to Garden of Life mykind Organics, redesigning packaging, advertising and point of sale materials, abandoning the use of certain slogans and agreeing not to seek trademark registration of the mykind Organics brand.
“We pursued this settlement with the best interest of the consumer in mind after receiving numerous reports of confusion,” said Justin Mervis, Kind vice president and general counsel. “As such, we are pleased to have reached an amicable settlement with Garden of Life and will continue to defend our distinctive trademarks and trade dress against any market entrants that cause consumer confusion in the marketplace.”
The rebranded Garden of Life offering is expected to be seen in the marketplace by January 2015.
