Exova’s team of expert Food Law Advisors are helping to create and verify nutritional and health claims for all food product types.
The health claims aspect of the EC regulations, which come into force as of 14 December, mean that manufacturers cannot make unapproved claims on packaging regarding a range of health and nutritional features.
For example, manufacturers of probiotics are particularly affected and need to carefully follow the regulations to ensure they are compliant in light of the changes to the EU list of permitted health claims.
Jamie Weall, senior food law advisor at Exova’s Food and Consumer Products division, said: “There are far more negatives to this new regulation about which food and nutritional components you cannot make a claim about rather than those that you can.
“However, claims and statements can still be made, albeit with sufficient due diligence and by following the claims approved within the regulations. Any manufacturer must be very clear about what they can and cannot say so that they do not mislead or confuse the public.
“It is important that the health and nutritional claims on other marketing communications are also presented correctly.”
