The civil division of the Nuremberg district court granted the injunction which was sought by the Centre of Protection against Unfair Competition (Wettbewerbzentrale), which had previously rejected an out of court settlement proposed by Lammsbräu last November.
The judgement says that the term ‘Biomineralwasser’ (organic mineral water) “contravenes the regulation on mineral and table water and it misleading, because natural mineral water from an underground source is always pure”. It goes on to state that the organic label awarded by a private certifying body (or which Lammsbräu is a founder member) contravenes the organic labelling law. Lammsbräu’s mineral water brand name BioKristall has not be challenged.
