POM Wonderful settles lawsuit against Fresherized Foods

POM Wonderful and Texas-​based Fresherized Foods Inc have announced a settlement to the lawsuit filed by POM Wonderful against Fresherized Foods on 22 September 2008.

The lawsuit was filed against Fresherized Foods for false advertising and unfair competition, and alleged that Fresherized Foods sold juice labelled 100% pomegranate juice that allegedly didn’t contain 100% pomegranate juice. Fresherized Foods exited the pomegranate juice business in 2008.

“We’re pleased that we’ve been able to reach this agreement with Fresherized Foods,” said Matt Tupper, president of POM Wonderful.

POM Wonderful only uses Wonderful variety pomegranates grown in its central California orchards. POM Wonderful’s management of the entire juicing process from tree to bottle guarantees that each bottle of POM Wonderful Pomegranate Juice contains 100% pure pomegranate juice, providing consumers with an authentic flavour and a consistent dose of naturally occurring polyphenol antioxidants.

In an effort to uncover the health benefits of the Wonderful variety, POM Wonderful has invested nearly $30m in scientific research. This research is performed by renowned scientists at the top facilities in the world, and has resulted in 13 published and peer-​reviewed clinical studies that indicate POM Wonderful 100% Pomegranate Juice may promote optimum human health, particularly in regards to the heart and prostate.
